She was given a ticket for failure to control speed. I have talked to a lawyer and will be seeing a doctor today about my back. I don't see how her insurance company is going to get out of this since she was at fault. Will keep you guys posted on how the repairs to car go. :shrug:

remember that you should be compensated for your injury by her insurance company. they will call you shortly to discuss this accident. it's a rearender so your not at fault.
i have not seen how hurt you are, but you should get at least 375.00 dollars for your pain and suffering.
you should go through her carrier for your repairs and rental if possible.
you may rent a comparable car while your car is at the shop for repairs. if you choose not to get a rental car, you may put in a loss of use claim against her insurance. they will probably pay between 10-25 dollars a day for each day your vehicle is at the shop.
 
i hate people that talk and drive knowing that they cant do both at once... then after hittn your car has the nerve 2 be ignorant and say what she said...dude sue her big time...and then buy a 05 saleen or cobra when they come out...hope your back is better....but 4 the record i would hate 2 get sued but when u r doin suttn stupid and then act ignorant ..u deserve it... good luck

lawyers actually slow down the process. if you do actually get a lawyer, make sure to call him every week for updates. lawyers tend to take months to resolve some issues, but usually get you more money which they later take a third.

i would talk to her insurance company first to see how they respond to your claim. a lawyer should be your last resort unless you are seriously hurt and need prompt expensive medical attention.

you should only be suffering from soft-tissue injuries. most of these injuries heal themselves within 4-6 weeks untreated. don't let the lawyer rack up your meds.

I too was rear-ended last week by a GMC Sierra. He was going 15-20 mph. I was at a dead stop behind 2 other vehicles at a stop sign. Thank God I was back far enough from the van in front of me that I didn't go into the back of them. I had 2 70# bags of sand in the trunk and they both got dislocated 12 inches from their original position. Coffee mug that was in the center console became a flying object and landed by the firewall on the passenger side. I started having horrible pain shooting up and down my right leg last Thursday, and missed work yesterday and today because of it. Soft tissue injuries sometimes take a long time to heal if they ever heal completely. Damage to my car -- $710. Car held up beautifully. Only need to replace the back bumper -- with Ford OEM bumper.
