Got Jumped New Years Eve!!!

So I'm out with friends new years eve. All suited up, at a college bar with buddies, dancing with the ladies, drinking, next thing that happens.... I open my eyes and someone is in my face. I start swinging my arms (habit when someone gets in my face) then I notice I'm in the ER of a hospital, and the nurses are calling security guards to cuff me to the railing. Of course, I calm down but I have no clue what happened. Apparently before I got to the hospital I was still somewhat aware that I was able to tell the police they had weapons and there was a few of them. That's when I basically blacked out due to a Concusion. Got a ride in an ambulance too they said. My ER discharge record stated I suffered from "CHI=closed head injuries" "wounds & wound closures," "sprains, strains, and a contusion" Basically I got my a@#$ kicked. What's even stranger is that while I was still aware (accourding to the police report), the cops asked if i wanted to press charges. I said NO and seemed like to be hiding who they where. I probably thought me and my buddies where going to take care of this ourselves, give'em a good ol woopin! I told them that I meerly feel down. But they knew I was assulted with a weapon. I'm pretty sure I know who they are too. Because friday night, the day before my friends dad who's in his late 50's got jumped right outside his driveway. He was only walking up the street after a poker game with us. He got jumped from behind like by two guys. Didn't take any money nothing. Just kicked his butt. His dad gave a description of the guys and the car he sped off in. It's a bunch of 20's somethings across the street. When we found out we ran up the street and went to those guys house. I ran right up to the door and got in their face. They said they kicked those guys out, who just did that. But the next day we saw the same car in the driveways. Filed a police report and basically the police only took a report. I think what happened is that because I was the only guy who they saw up front, everyone else was down yelling from the street. That they saw me out that night and decided to jump me too. Well, they got me pretty good. On the brighter side I don't have to pay $30 for dry cleaning because my suit was covered in blood and ripped to shreds. Still had all my $$ cause they didn't rob me, which makes this attack seem more personal. Rather than just some guys trying to roll me over. I don't know what happened to my buddies, but from what I'm piecing together from different people is that they were storming around the bar pissed off looking for these guys and ended up getting thrown out the bar. I literally have what looks like 2 pipe dents in my left skull, gash on the rightside my head, inside bleeding from the right ear, knees got smashed to, and my face is all swollen. Can't drink water without it running down my face and my jaw feels misaligned. I'm a big guy 250lbs and have no problem settling differences the 'ol fashion way. Hell I can stand my own handling two men. But like I said I only do it with fists, no weapons. Now days people just don't have respect for that, they want to use knives, knuckles, extend batons, tazers, guns, etc. There's just nothing you can do when a group sneaks up from behind you and hit you over the head :chair: with something, GOODNIGHT! It's a New Years I'll never forget. My friends mom is an attorney and will probably be hiring a P.I. to investigate. Since the police don't seem to really care. Trust me we will be pressing charges and looking to get them jail time. Looks like I'll be renewing my concealed weapons permit :uzi: Glad I made it back home alive. Otherwise I'd be a bit pissed in Heaven if I wasn't able to install the new springs & struts/shocks I just bought thursday. :SNSign:

call the police and explain to them that you want to press charges if they find the people involved.

obviously your mental status was lowered. Especially if you had blacked out. I am suprised they would ask you that based off of your description of your injuries.

head injuries make people do really wierd stuff. Fighting and agitation is one of the more common ones I have seen. Your brain isnt functioning correctly so It goes into survival mode.
 
I'm going to call the police back and let them know that I do want to press charges if they found out who it is. But they said it's not like anything is going to happen because I didn't physically see who did it. I told them how could I if they came from behindme. I can almost guarantee it's those same guys from the night before, but can't prove it. Hopefully the P.I. will be able to gather more information and possibly video tape. However this bar is well known for not cooperating with police. Infact if a guy gets beatup inside or falls down the stairs they throw him out off the property before the cops arrive so they can't get sued. The hospital instructed me not to sleep so much after a concusion, because the hospital said I might suffer more. But I've basically sleep for the last two days, haven't really ate, and occasionally I see white bright flashes out the corner my right eye. It's an awful way to start 2006 too. My grad school starts this week and I may have to postpone until I get over my injuries.

When i woke up at the hospital they where in the middle of stiching my face. I paniced not knowing where i was, plus they had that really bright overhead light in my face. So I began swinging my arms and punching anyone nearby. They ended up calling security and threatened to cuff me to the railings. I looked around and felt bad for the guy next to me. I asked what he was in for and he lifted both his wrists. He tried killing himself that night by slicing both wrists. Young guy couldn't of been more than 19yrs. I'm lucky i was able to leave, because they wouldn't let anyone leave their bed. The only way they'd let me is if you called someone to pickup. However to use a phone you'd have to leave your bed, which they didn't allow. Lucky I had my cell phone still!

Exactly......You had an altered mental status from a head injury, and/or alcohol intake(?). They have to investigate and press charges under implied consent laws. Anyone who is not capable of making decisions rationally due to head injury, etc., we assume that they would want treatment and go forth with that treatment. This also goes to law enforcement. Don't take things into your own hands, all it will do is get you in trouble.
 
Damn man sorry to hear this glad you seem to be making progress to a recovery! Looks as if i'm not the only one with a very bad start to 06 tho! When i was comming home from "MONGOOSE'S" house saturday night i seen like 4 guy's beating up this one guy along the roadside they just crossed the street in front of me from a party and just started beating this guy :nonono: . peace

You did not have the mental capacity to make the proper call when they asked you if you wanted to press charges, therefor they cannot hold you accountable for your actions while you were under that state of mind.

I work in an E.R and we see this all too often which is very sad. It pisses me off when people get jumped from behind as it's just such a cheap way of hurting someone.

It does look as though you are alright which is awesome as you still have your brain intact enough to be able to put sentances together as well as type them which is a BIG peice of the puzzle.

I say if you find out who it was we settle this with street justice v.s law. :D

I seriously doubt that if it happened to your son, father, brother, girlfriend, or mother, etc... that you would be saying that. It's easy to say what your saying, especially if it didn't happen to you. At this moment I've stepped back and am hoping the police get do what I pay them to do. I'm seeking to get them jail time and counseling help. You can't replace the security you lose from being attacked. It becomes very personal. It's like it's not even safe to take out your trash. Or like having your house robbed. That someone can walk right in and get you. That's how I feel now. And like the majority of people who have been victimized. I'm going to take precautions to prevent being a victim again.
 
sorry to hear what happened to you. when the police find out who did this i would press charges. i agree that it is more personal when it happens to someone you know wether it is a family member or a friend like you. just worry about getting better. give me a call if you need anything.:nice:

By referencing Paul's earlier comment, I meant to draw particular attention to this statement. If the culprits do, in fact, turn out to be these dickheads, you invited retaliation. In no way do I condone their alleged actions. However, there were better actions that you could have taken (ie. call police, file the report, possibly involve the PI), short of "getting in their face." As for such crimes, I do know what it feels like, though not first-hand. I have had close friends mugged, my property vandalized, friends horribly beaten, and have been in my share of scuffles. Almost every time, the police have been slow to catch the culprits. Almost every time, it has been apparent who the culprits were. Case in point: Fort Benning, Georgia. After taking a taxi back to post at the end of the night, we were dropped off by the taxi driver. He then picked up some other soldiers, and left post. These soldiers were both newly enlisted and apparently didn't have money for the cab fair. What did they do? They beat the poor guy within an inch of his life. About ten soldiers in my company knew who the two guys probably were. Since pretty much everyone there was infantry, the consensus was to find the two guys and give them a beat down. Instead, we spoke with MP's and let them handle it. By the time I finished jump school, the guys had been caught. Don't let emotions get the best of you. In the end, you may be charged with assault and they may get away with everything. Be smart about it.

WTH are you talking about? Implied consent laws have to do with drinking and driving. With a DUI, vehicular homocide, or vehicular assault, and a person is unable to respond then blood is taken from that person. Implied consent has nothing to do with pursuing crimes.

Back to the topic at hand. By declining to press charges you have not relinquished your right to change your mind. People do all the time. Additionally, the police do not need you to "want" to press charges to pursue charges. Case in point, domestic violence. Regardless of if the "victim" wants to pursue charges, an arrest is made.

If you have changed your mind in regard to pursuing charges, pick up the phone and make an additional to your original report indicating that you DO want to press charges if a suspect can be identified.
 
At this point I've gotten a detective to handle my case. If those involved are found the detective will notifiy me and charges will be pressed to the fullest. For now I'm moving on with my life, but def with a whole new perspective on things. Plus I've got grad school to worry about and trying to building another motor. PEACE :nice:
