Gonna sue over my racing seats ordered

I ordered pair of racing seats from HYPERFORMANCE.COM 1-29-09 and 3 weeks later they shipped me the wrong seats, they were black instead of gray so I called them than they told me to refuse the order and have them sent back so i did but i kept the receipt, Well i've been waiting since than and its already a new month march and still no seats, I've emailed them and called no answer, than I got curious and looked them up online for peoples complaints, read this guys

THIS IS WHAT I WROTE THEM INCLUDING THE COMPLAINTS I FOUND * one guy got done just like me sent wrong seats and they tried to substitute the seats out by saying their better quality what a rip off, I hope I get my refund back in full or their getting sued,,,,,,,, read this

Im considering a lawsuit after reading on the internet about your website, I've got more than 20 post's linking to problems with you guys on racing seats and 2 people got done the sameway you did me by shipping them the wrong seats and trying to substitute them out, I want my money back immediately or you got a lawsuit on your hands I've already spoke to my lawyer and I've waited over a month for my seats this is rediculous so I kept the receipt from the wrong seats shipped for proof so without any problems or hassle I expect full refund for the seats, i'll take my business elsewhere, thank you

Ripoff Report Verified Safe

Ordered a set of race seats for my mustang, what a mistake. One, the seats I ordered off the website were not the seats delivered, two when contacted they gave me some run around about that the seats I ordered were inferior in quality (if they were the site did not contact me to notify of this), three the 'upgraded seats' are not the right color and four when I asked about return policy since theese were not the seats I ordered they were very reluctant to process and wanted to charge a 30% return fee when they did not send the right seats in the first place. The capper was that after 30 minutes of haggling the woman I was speaking to suggested that since they gave me an upgrade I should sell them on ebay and get my money that way and then order more seats from them! Wow these guys need to be avoided at all costs!

A note to anyone who buys car stuff online: DO NOT PURCHASE FROM SHOPHYPERFORMANCE.COM. I ordered a pair of seats from them due to recommendation from a friend - the purchase date was March 16. I told them I absolutely had to have them before May 17, which one would think was no great feat - they are located in Baldwin Park, California. Their customer service is abominable, they don't answer the phone, they rarely answer emails. They told me the seats would arrive at my home in 10-14 business days. Four weeks later (April 15), I finally got one of them to reply to me:

Three days later, I asked for a tracking number; they told me to allow 5-7 days for delivery. April 27, I sent them another email asking them essentially where the hell are my seats. This was all done by email due to no customer service rep answering their phone. They replied to me a few days later telling me the seats had been back-ordered the entire time, and that they would ship out the following day. Still no tracking number. I sent them numerous emails, and was assured that the seats' arrival was eminent, even to May 14, they told me the seats would be here within 5 working days. It was only this morning that they shipped the damned seats out, and provided me with a tracking number after much badgering.

In conclusion: terrible customer service, horrible communication, and rude representatives. I highly recommend avoiding shophyperformance.com. Like the plague.




Beware of "ShopHyperformance"

Just a word of warning to club members re the internet store "ShopHyperformance" or "Hyperformance". To Illustrate, here's a summary of my experience with this retailer. In September 2007 I ordered 2 racing seats from their site (which showed as being in stock). After a month without any response (even though my credit card was billed for the seats), I followed up by phone and was told the seats I ordered were out of stock but should be available shortly. More time passed and I again followed up only to be told the seats were still not in stock at which time I was offered a free upgrade to simulated leather seats. I declined the offer as I was looking for grey seats, not black. I suggested other seat models from their catalogue, all of which were "back ordered". Several more calls and I was told they had found grey seats for me and the seats were shipped to me express as compensation for the time delay. However, when the seats arrived they were black,not grey and badly damaged due to inaddequate packaging. I refused the shipment. Again I was told I would have to wait until the damaged seats were received back at their warehouse before anything could be done. That took another 2 weeks at which time I asked for a refund. Several more months passed with a phone call to them daily. I was told for reasons unknown they were unable to process a credit to my card and I was asked to have my bank call their bank to help them process the credit. My bank refused to do this so I asked for a cheque instead only to be told issuing a cheque to me was not possible within thier internal processes. Almost a year after the initial order was placed they claim a cheque was sent by courier but not picked up by me and subsequently returned, however I received no notice from the courier company of attempted delivery and for reasons unknown they claimed they would have to issue a new cheque. They again claimed to have sent the new cheque to me only to have it returned. Seems they sent it to the wrong address????. After 4 more months and a phone call from me daily, and an offer to purhase a Magnaflow cat-back with the money they owed me (which they could not provide as they don't carry Magnaflow even though they advertise they do) they finally sent me a cheque but deducted almost $200 from the amount owed to me for shipping costs for the seats which were sent even though they were black not grey as promised and badly damaged. So 16 months after I placed my initial order, I have no product and I'm out $200. Seems there are a number of complaints against this retailer via the Better Business Bureau, however they are not a member of the BBB so the complaints are unresolved. So watch out for this retailer if you're looking for performance parts, investigation shows their main business is handbags and jewellery, not automotive performance parts, they don't really sell everything they advertise and they seem to rely on the "bait and substitite other product approach" to sell what little they do have, all of which comes from offshore.

if you payed with a credit car just file a dispute with them. credit card companies have the power to refund your money from the other company. the problem with small claims court is:

A. it takes time and lots of headaches
B. even if you win, its often still a battle with the company to collect the money.


how much are you out for the seats?
 
not a huge issue...just file a complaint with paypal...since I assume that is how you paid....you will have to send the seats back...on your dollar, but you will get a refund...end of case...

anytime you make a lawyer threat, you lose credibility...since the worst that will happen for them is a refund...why not call your bluff?

file a complaint with the BBB...that is more effective!
 
This is how it all went down, On jan 29 I ordered the seats online through their website using my debit card, the price for both seats and shipping comes to total of $445.23, so after 3 weeks of waiting they finally email me and tell me my seats are shipped, well they arrive and their not gray like I ordered, their black? So I call them and they say your seats you ordered are backordered so we decided to ship you REAL LEATHER SEATS instead *without notification to me that is* SO I said I dont want them they dont even match my interior plus they had broke peices on it so they say refuse the seats and send them back *NO CHARGE* so I did, They received the wrong seats shipped FEB 26, they said my seats are still backordered so it will be another 3 weeks before they come in is what was emailed to me, well its march 10 and I wrote them a email 3 days ago and have got no reply yet?! So I did some investigation on them and found those REPORTS on their service and I've had enough I want my money back period.

Im not gonna go through court if they refund my money but if they try to give me the run around I've got the receipt from the wrong seats shipped and all the information from order time including FEXEX tracking # from shipped wrong seats and sending them back
 
they sent me the wrong product on purpose trying to scam me and think i'd accept it, thats what pisses me off, instead of saying hey your seats are backordered they try and hoodoo me I should of known, I just found my same seats I want from summit racing and their cheaper go figure, I hope i'll hear from them tommorro and get this taken care of without having to go through the BBB or call my bank
 
skip the BBB, they are useless.

i try and buy larger stuff like that in person. the only seat ive ever bought was a leather cobra daytona for an office chair. i went to subesports and bought it in person.

also on large purchases i always use my AMEX, their dispute process is amazing.

I don't know what you were doing with the BBB but I have never had anything but results when contacting them. It is a simple online form to fill out that takes like 5 minutes and it keeps an online record for others to view so they don't make the same mistake.

I have done it about 5 times and always had success. I have bought/sold over 7,000 things on Ebay, and only a handful of issues that were fixed by BBB/Paypal...
 
Dispute it with the bank. You'll get your money back much sooner. I went through an issue a few years ago with a vendor that no longer exists, fortunately, (CR Motorsports) where I ordered some TFS Twisted Wedge heads, was billed for them, but never got my heads. After 2 weeks of being dicked around, I disputed it. I had my money back in 3 or 4 days.

the lady called me first thing this morning apoligizing and telling me she wants to fix this immediately, so she starts by saying I can send you black seats just like the one you ordered if you want those than I realized shes still trying to hoodoo me god people make me sick, I told her I want my refund forget about the damn seats so she said it would take 5 - 12 business days before my credit card gets the money back on it so well see what they do, their a stupid company dont ever use them, they say their seats are back ordered but SUMMIT racing has them in stock so dont ever and I mean ever use hyperformance.com for anything
 
on another note, its funny she said she'd send me set of black seats just like the ones I ordered but they were out of gray, well turns out they already did send me black ones if you read my first comment in this thread lol I mean c'mon this is rediculous, they tried to send me the same seats they screwed me over with the first time again, I hope they lose their company cause they dont deserve it
