Good to hear that you got off so easy, it's not that liberal up here in Ontario... I will drink only 1 beer without handing over my keys, after that, no driving for me...I used to drink and drive quite regularly, until I had a pretty decent scare one lovely evening...
In Florida the Driver's License says, "Operation of motor vehicle constistutes consent to any sobriety test required by law." If you deny a sobriety test you can lose your license for 6mo-1yr. Kind of their way of reinforcing the concept that driving is a priviledge, not a right, so you have to play by the rules. It's actually a pretty well planned law if you think about it. If you decline to a test, they don't even have to consider that "you're admitting your drunk." If that's their only grounds a lawyer can break that later. But if it's against the law for you to decline the test, drunk or not, they gotcha.
Ya, i didn't think i was supposed to have to take the breathalizer unless i failed the sobriety tests either. I don't know, but he didn't write on the ticket that he pulled me over or had a reason too, or write a seperate ticket for a motorvehicle violation. so im talking to a lawyer and i think i can get it dissmissed for him not having a reason to pull me or at least not writing me up for it. ya, im not a big fan of the drinking and driving thing either but i didn't feel any buzz and my 3 friends only other choice was someone that was prolly .15 or more i know it waas not a good choice, i was just pissed about it all when i posted that, cuz i don't have the money to deal with this... blah.
GHEY!!! You got caught, and you're gonna try to get out of accepting responsibility for your actions just because the cop cut you a break on the headlights thing?(which is not grounds for dismissing the charges against you) This is what's wrong with our society; everyone wants to pass the blame. You got caught drinking then driving, so it's the cops fault? Everyone seems to agree that you already got a pretty good break. Why not just take the punishment like a man? I've got some friends that had to, and it sucks, but they learned their lessons.
