hey everyone im confused about civil/human rights.. i was watching some cop show! and somebody got arrested for interfearing with investigation, by talking,then the officers kept telling him he was resisting cause he kept asking for permission to talk... i know he was being a douche,but thats not illegal.....under what right can they arrest him for!!!!!!!!! also anothe guy got arrested wihtout being read his mirrand rights???????? and the sheriff said he doesnt have to read them.,,,..can somebody please explain sometings to me,in case one day im i trouble,i want 100% defense against those arrogant and power hungry cops... good cops a-whole cops im sorry but damn,why?
i'm not an expert by any means, but as far as i know, interfering with a police investigation is a criminal offence. if the police are trying to do their job, and some loudmouth won't shut his mouth and let them do their job, then they have grounds for an arrest. resisting has nothing to do with it, they were probably just caught up in the situation and said the wrong thing to the guy.... miranda rights must be read before someone is ARRESTED, so i'm guessing they didn't arrest that guy. they don't need to be read before detaining someone though, which i'm guessing is what they did.
The interfering charge was pretty well covered above. I didn't see the show, so I don't know if he was trying to turn around to talk while being cuffed, so I can't comment on that. They don't have to read your Miranda rights at the time of detaining you, although they should. The police can legally hold you for 72 hours before charging you with anything, so at 71 hours and 59 seconds, they can read them to you, charge you with an offense, and it's legal. The problem for the detainee/arrestee still lies in the fact that up until them reading you your rights, they're still conducting their investigation, and anything you've said up to that point can still be used against you in court, and will be admitted as evidence, if you said anything incriminating.
the miranda rights only apply to questioning. they only have to read them if they are questioning a suspect about the comission of a crime once in custody.
Miranda rights do not have to be read at the time of an arrest unless they intend to question at that moment in time. And I wouldn't really "legally" try to **** cops off cause there are all kinds of "legal" ways that they can make things even more difficult for you such as what StangGT1995 described about being detained.
You dont want to do this by any means. I used to be a cop and trust me doing this can go many different ways. My best advice is if you have a situation deal with it get all your facts and call a lawyer. Very true. Most cops are honest people, but there are still some bad apples. They may smile in your face and put your face through a window, or something. I'm currently applying to some police departments, looking to become a cop myself. What dept were you with LS?

Yikes, you had a busy job. I'm applying at Highland PD this week. I missed the Porter County Sheriff's PD application deadline, but wanted to apply there, too. Didn't have enough time to get all the required documents together, since I checked if they were hiring 3 days prior to the deadline.
not really sorry to hi-jack, since & i don't want to start a new thread, but what do cops check when they take your insurance? they run you're registration, but do they just look at the dates on your insurance card? or do they actually run your policy #?
Yup! every time i've been arrested, the disclosure has had everything i'd ever said, before ever being read my rights. and then some more stuff that never even happened in a couple cases!..... they even make notes on how you're acting, walking, talking etc. that they will use against you in court.
WOW Highland well you'll be bored to death LOL & also thank GOD you missed that Porter County deadline.... Do you have any experience? Whats your age? Sorry for the crazy questions but if your young enough try to go somewhere warm or nice less stress and when it comes time to retire your already there... I almost went to Las Vegas P.D. but in the down time of waiting to go I started driving trucks and let me tell you I sleep alot better @ night, me and the wife have far less problems, & I make more a year NOW than I did working Patrol, overtime,& a second job. Just something to think about good luck on what you decide later
What's wrong with Porter Co.? I think I'd take that over Lake... I have zero LE experience, just grew up around it. I'd like to stay in the area, and mostly, would like to get back toward NW Indiana. Moved out here to this cornfield 6 years ago, but I still go back out there to visit friends. Most of them are moving out toward Portage or Chesterton anymore, so the Porter Co job wouldn't have been a bad gig. The only problem with Highland is that you have to live in Lake County, so I'd probably end up out in Hobart or Lowell if I wanted a decent place to stay, that's within the 15 mile corporate boundary rule that Highland PD has. I looked at Hammond, but laughed when I saw they start their probationary officers at $32,000, and you have to live in Hammond? No thanks! I'm 27 now, and will be 28 in March, so I'm at the point where I just need to do it, or find something else. I'm sick of healthcare. Too much micro management, too much supervision, etc. I've been doing this for 6 years, I don't need someone to hold my hand through the entire process. I know the job, that's why my evaluations always come back spotless. That's why I'm our main preceptor (I guess you'd call that FTO as a cop) on night shift, and I'm our main cardiac monitor tech, too. I like helping people, but I'm really starting to think healthcare just isn't what I was looking for. Plus, when people start giving me attitude at the hospital, I have to kiss their ass. As a cop, I could give it back. Oh how I long to be able to do that...
Man I love people like you, the ones still talking crap in cuffs sitting in the back of cruiser.."what I do" . resisting arrest doesn't mean you physically resisted like most people think but the fact that you wont go peacefully, once you get the cuffs on shut up and you can avoid the charge. you can aslo be charged for interfering with Fire and EMS the same way and get arrested. you can't just go up and taunt police even at a heated incident, most of the time though they will give you a warning or two then it's game over. they have plenty of charges they can use loud mouths like disturbing the peace, disordally conduct, etc. they have a right to hand cuff you for thier own protection to conduct an investigation, they can detain you, they can make your life misrable. So don't be a prick, keep your trap shut and let them do thier job, yes there are hard azz cops out there but if you are the one f'en with them who now is the a-whole.
My advice for people w/ this mentality: When they approach the car from the rear, dive for the glove box as quickly as you can to reach your registration. They love that and will be very helpful and nice there forward in said situation.... And yes, it is sarcasm and could get your ass shot. So don't do it.
lol,you guys are funny,actually im the guy with a clean record and respect for cops, but one thing i will not respect is douche bag power trip cops, i know they deal with ass whole people, but some people need to realize that good people make mistakes, i have only had one nice cop md he was the one who gave me my only speeding ticket(go figure)!!!so lay off, i was just looking for legalities for defense against a-whole behavior..but w/e...cant beat em join em,,,F the popo's j/k....
How to deal w/ a douche bag cop. Be respectful, don't bite when they try to bait you into a situation, and if you feel you were treated unfairly after the event; call their station and file a complaint. Get a name and badge number and be as specific as possible. Usually it pisses the a-holes off even more if you are courteous and don't get into a pissing contest.......... go figure.
If you're looking for something to say if you do encounter an officer who is being rude, but you've been respectful, point out that fact in a nice manner. It worked for me once, and he actually apologized. I just said something like, "Officer I've been nothing but respectful toward you, could you please show me the same respect?" I think he was even more pissed when I said it, but it changed the tone of the whole stop, and I got off with no ticket.
