how much to repair this

I was in an accident because the guy hit me and i only have liabilty and uninsured and it turns out the car the man hit me with wasnt hit car and he has no insurance and the guy who owns the car isnt covered either so my uninsurance is going to go though on wed and i have a couple questions.

1. this was my first accident and someone said that the insurance company gives you a check to fix your car or not is this true?

2. how much do you think it will cost to get a new quarter panel welded up not painted just a new panel?

3. if i take it to a shop for an estamete would the insurance have to pay more if it ends up costing more than the shop stated? also i was thinking of taking to for d for the most amount of money only i get a check.

4. i was injured in the accident and i was told i can get compensation for that what do i do to get that i have paper work saying my muscles in my neck
was hurting bad.

Well here the tricky part. To have a new quarter panel welded and painted runs in the 1500-1800 range. At least in Cali, i was hit in the same spot and those were amongst the cheapest prices i got for that exact same work. Now.........heres the bummer. The blue book value for a 92 mustang may not even be that. So the insurance may decide to just junk your car and cut you a check for the value of your car. In that case you will have to buy your car back and fix it. So if they decide your car is worth 1500 then you get a check for 1500. You then have to pay them 500 to buy the car back from them. Then you'll have to pay up 500-800 out of your pocket to fix your car. But then your car will have a salvage title and you will be stuck with it forever because everyone is weary of buying a car with a salvage title. I know it sucks but...........well it sucks.

ohh yeah, also.......you might wanna look up the value of your car first. Then be carefull not to blindly go and get the most expensive quote. If you exceed teh value of the car they will total it.
definetely watch out for that, don't try to make to much money on it, it's more trouble than its' worth.

And Mat, could you organize your thoughts in number 1., it's kinda of confusing.
 
i had my car rebuilt and i dont have a reciept for it but my engine only has 20000 miles since rebuild and according to kelly blue my car is worth 3995 but if they go of of the total miles on the vin is 159000 which makes my car 2995 what will they go off of i can probably get the shop that did it to give me a reciept but how does the insurance company determend the amount its worth.

Question 1: When the insuance company determens the amount to damage say 2000 because thats what an estamte says do they send the check to the shop or can you get them to send the check to me. so if i find a cheaper place to fix it i can have extra cash.

i also want to know how to i get medical compansation for pain and suffering who pays that out in a situation like this? do i have to sue the guy? i have AAA in California as my insurance company.

nito88stang how long did it take for repairs? and how much was it just for the quater panel replaced no paint? because i have been wanting to paint my whole car and i figure since the back has to be painted i should save that money and just do the whole car.
 
This all depends on your state laws and your insurance company. As far as pain and suffering - have you been to a doctor? What is the actual damage done to you? Pain is subjective. GET MEDICAL RECORDS! Did you go to the hospital? As a heads up, anytime you get into an accident and feel ANY pain, go to the ER. If it winds up being nothing, no loss. If however you have injuries this will help your case should you need to pursue compensation through the courts. To a court someone who was fine at the accident scene (didn't go to the ER) seems a little suspicious when they claim injury later. Also medical records, pictures, statements, police reports, photos, estimates of vehical damage will all be helpful should you decide to sue. If you are talking about sueing and haven't seen a doc yet, then you should think about your motivation here..... Also your auto insurance should cover any medical bills incurred although the may coordinate benefits with your regular medical insurance. - depends on state laws and your insurance company.



As to your car, some insurance companies will cut you a check for repair, some will handle it with the shop. In most states, unless you have collision you are outta luck anyway, you insurance will tell you that you don't have coverage for the repairs. Then you have to decide if fixing it out of pocket is worth it. If not, part out the car and you may wind up with enough for another nice stang.

well my accident was on a sunday at 12 in the morning i didnt go to the er intill wensday becuse i didnt have pain the next day but after another day it started to hurt so i went to the er and they said i tore a mussle in my neck and gave me medicien but i didnt go right away will this hurt my case? the doctor also said it takes a couple of days for it to hurt. also i didnt get any papers saying my pain he just told me what it was. he should have written it down right. also this car has been perfect and ill be so mad if i have to part it out.
 
Call your insurance agent. Don't mention suing anyone while talking to him (insurance companies don't care for that much - I used to work for one).

See your family doctor about the neck pain. If the pain persists ask to see a specialist, have Xrays and if warranted an MRI to rule out disc damage etc. Basically you are going to have to wait it out and see how much damage etc. has occured before you can/should do anything about it.
