why did 2008 get screwed for CARB legal superchargers?

just like the title states...

i was thinking of buying a 5.0 fox for a project then got the idea of just boosting my 08 til i found out 08s do not have a carb legal supercharger kit.

what gives?

also can you have a dealer install a roush kit and retain the factory warranty?

Sure there are: Edelbrock e-force, Roush, Whipple and others. I'm pretty sure Saleen, Techo and others make 50 state legal kits too. I think the Roush will retain the warranty and I know the FRPP/Whipple will if a dealer installs them.
 
if you look on vortech and edelbrocks site they sate CARB status pending on 08 models.

Smog Certification In Process for 2008 Vehicles

"These systems have not yet been approved by the California Air Resources Board for 2008 model year vehicles. For this particular model year these systems are currently legal in California only for racing vehicles which may never be used upon a highway (off-road use only)."
