Transmission Is Screwed

About a month ago I started having problems with the stangs transmission and had to have it towed from my house to the dealer. The problem was not consistant and it seemed like every time I started the car the tranny would screw up in a different way.

After having it for two weeks without it even being touched the dealer called and said that the the tranny would have to be rebuilt or replaced and they were waiting for a reply from Ford Motor Co. as to what they need to do.

Week 3: Get a call from the dealer Ford says rebuild... :notnice: They say it should be done early next week.

Week 4: After having my patience tested for a whole month I decide to go to the dealer and see what the big hold up. When I get there they tell me they are covered up but yet i only see 5 or 6 cars outside waiting for service or repair and i ask when my car should be done...next week they say.

I have about had it with this crap...Im about to tell them to shove the car up there fat arses. The car only has 6300 miles on it and this whole situation is complete B.S. :bang:

yes 30 days is a lemon and / or 4 times in for the same problem.

I would definitly call Ford and open a case with them jsut incase you to go lemon, better start to document everything, keep a log in a notebook.
i did it with my 2005 S4 and after 6 months i had my money back

Good question. Interstate commerce under the Uniform Commercial Code for other products would say Yes. However, I would review the lemon law law link I provided and check the legalese. I would think ANY dealership that has worked on the car, not the selling dealer, has to make the fixes within the time frame or number of attempts indicated. It would make no sense to require you to return the vehicle to the selling dealer as that would cause you undue hardship.

We called the company that towed it to the dealer and asked them what day they picked it up and they told us 8/16 so its only been 27 days and i dont know if we can count sundays since the dealer is closed HOWEVER the kentucky lemon law says (after reading it and highlighting sections to shove in their face) "after 30 days out of use or service." Technically it has been 30 days already because the car messed up a few days before they towed it. Now I'm hoping they drag their feet a few more days and I will be calling a lawyer...Ive already picked out a new tungtein(sp?) gray gt conv. that I think would be quite the wonderful replacement.

Not that it makes a difference in your case (since it's close to 30 days at the dealership) I don't think you can count the days BEFORE you notified the dealer about the problem and brought the car in for repair.

Let's say that something goes wrong with my car (engine misfires/runs rough, transmission starts acting up) for a month or so before I decide to take it in for repair. Since I had the problem for a month would I be able to say to the dealer 'I've had problems for a month and the car is a lemon, can I have my new car please?' and drive off the lot with a new car?

I would think that the lemon law applies once the car has 1) been out of service for more then a month AT THE DEALER or 2) the dealer has been unable to fix the problem after something like four times before the law applies.

In your case I think that you might be able to get a new car since it's close to 30 days since the car was towed to the dealer.
