Got In An Accident This Morning!

Let your insurance company deal with her insurance company. Don't tell her insurance anything until the report comes out. Yeah and don't approach her. She and her husband might pull something and make the situation look worse.

If she got a citation for failure to yield right of way, there is NO way her insurance company will find that it was your fault, and sounds like the police report will be in your favor also. Similar situation happened to my dad last year - it's totally balls but you'll get through it heh.

exactly what they said. you'll be fine. just don't do anything dumb like confronting them. that would make it bad for you.

I had a very similar accident in January. Once the cop gives her a ticket for failure to yeild the right of way, it's over.

If you have her company handle it, you will have no out of pocket. If they give you any trouble, go through your company's collision and pay the deductable. Your company will fight for you and you get the deductable back in 3-6 months.

Don't worry about it. It doesn't matter a damn what the foolish driver says. Nada.

Claim is Approved!- Diminished value?!

Thanks guys. After reading all the replies and stories, i feel better about the situation.
I am going to stand firm because I know I am not at fault. I want to handle this through her agency because she is the one at fault. I feel I should not have to go through my insurance or have any out of pocket expense. They need to take care of this. Period. If push comes to shove and they deny my claim for whatever reason, I will reluctantly go through my insurance to fight them at that point. It is my understanding that if the other party is at fault, they must pay the bill no matter what the expense (within the policy limits of course). They cannot simply total your car. Only your insurance company can do that. Someone correct me if I'm wrong.
My best friend is a cop and has a good relationship with a auto body shop. I am going to see if we can work in a full paint job instead of a blend due to the age of the car. This would be ideal because I have rock chips on my hood and flaking paint on the lower front bumper.

Funny thing just happened!I was at the end of typing this post and the adjuster called and notified me they are accepting liability! I do want to pursue reimbursement for diminished value now that the title will reflect an accident (it was previously clear). Any ideas on how much the accident may have decreased the resale value?

Getting them to pay more for diminished value due to an accident just wont happen, sorry. The insurance will only pay for the car dammages and injuries you suffered, you do have whiplash right? :D Glad to hear they are taking care of it, I really didnt have any doubt they would.

Thanks man. The Insurance estimate guy just called. I asked about the diminished value compensation and he stated that they do offer it and that it is settled once the repairs are complete. Does anyone have any experience with this?

If you can get them to cut you a check and not pay the body shop directly, there should be no accident on the vehicle history. The bodywork doesn't look like it'll be too bad, likely just a new door skin, and whatever may have been damaged inside the door. More than likely, just looking at the picture, the door frame itself is fine. The expensive part of the repair will be repainting the door and 1/4 panel, but as long as you get a few decent estimates, they'll usually pay somewhere around the middle, to cover any unforseen costs once the repairs begin. If you use the cheapo estimate, you can probably pocket a few bucks and be as good as new. Good luck!

Don't go too cheap, just stick with the local small trusted shop instead of the mainstream lines of shops - the small shops work based off reputation, the bigger chain shops work off of advertisement. Trust me on this

new door skin?? ummm hell no. get them to buy a new door and replaced the panel and everything inside the door. it is your mustang but if it were me I wouldnt be cheap on any of it. IMO it needs to look like you had it before they ruined it or better.

Dude thats killer! I asked about it before and the company (Progressive I think) didnt offer it.

Dude, I am sooo with you on that one! They are replacing the door and side scoop. The rear quarter is slightly damaged so they will try to repair it. I specifically asked the estimate guy about the Steeda door panel vinyl and he stated that will be covered also. I need to get with the body shop to let them know where to find it. It looks like they are sold in pairs right? If so that's awesome so I can have new vinyl on both sides.

My buddy knows the owner so I'm meeting up with him today on prices for some stuff I want to get done. My hood has rock chips I would like to be fixed, I want to fill and paint the spoiler holes on the trunk, and I really really want an 03 cobra front bumper. We'll see what happens!

yeah most body shops are willing to work with you. especially if an insurance company is paying. When I was in texas my auto insurance didnt have any adjusters in the area to look my civic (back in the day) lets just say I got a few other areas "touched up" for nada.

The other party's ins. co. can in fact total your vehicle if the cost of the repairs exceed the value. Luckily, your repairs will not come any where close to totaling your car.:)

The accident can show on the vehicle history anytime an insurance co. pays out on a claim.

Progressive does in fact pay diminishment of value (DOV) but it depends on the insurance laws in a particular state. My wife was hit by someone with Progressive here in GA and received a DOV check for it. Many states do not have DOV laws, so yours may be one of them (but I could have swore Texas offered it last I checked). There are also limitations on the mileage of your vehicle in some states. In GA, you do not qualify for DOV if your car has over 100K miles or more.

DOV is usually calculated using the guidelines for a particular state once the total cost of repairs is finallized.

OP:
Looking at your door in the pics, I'd say that the door skin as well as the shell needs to be replaced, as most likely, the reinforcement bar is compromised with that kind of a hit. The rest can be repaired other than the scoop.

Let me know if you guys have any more questions

The State was Hawaii at the time and the more I think about it, it wa AIG
Also the car had 108K on it so IDK if that was it.

Well about the $500-1000 bucks.. Umm i had my car broken into and the door lock was busted out and they had to repaint the door (they ended up repainting the whole side of the car cuz i had an inside man working at the body shop) and it was about $2400!!! not to me, i just paid my 500 deductable and it was all fixed up. I just had to get a police report and called my insurance. They took care of the rest.
Let us know what happens!:nice:

Very sorry about the car. Really glad you didnt get hurt and glad that your Fiance' wasnt sitting there. This post might look very different.
